Renting a property in the UK comes with certain rights and responsibilities for both landlords and tenants. As a landlord, it's crucial to understand and fulfil your obligations to provide a safe and comfortable living environment for your tenants. In this blog, we will walk you through the key responsibilities you have as a landlord.
1. Energy Performance Certificate (EPC):
An EPC is a legal requirement for all rented properties in the UK. It rates the energy efficiency of the property on a scale from A to G, with A being the most efficient. Before renting out a property, you must obtain an EPC from a certified assessor and the rating of the EPC must be an E or above. The certificate must be provided to potential tenants, allowing them to make informed decisions regarding energy costs and efficiency.
2. Gas Safety Certificate (GSC):
If your property has any gas appliances, such as a boiler or a gas hob, it is essential to obtain an annual Gas Safety Certificate. This certification ensures that all gas appliances are safe to use and comply with the Gas Safety (Installation and Use) Regulations 1998. Make sure to hire a Gas Safe registered engineer to conduct the inspection and issue the certificate to you. The gas certificate must be supplied to a Tenant before they move into the property and every time a new one has been carried out.
3. Electrical Installation Condition Report (EICR):
As of 01 April 2021, all rented properties in the UK must have an EICR to ensure the safety of the electrical installations. An EICR must be conducted by a qualified electrician who will inspect the property's electrical systems and issue a five year report. If any issues or safety hazards are identified, they must be addressed promptly. An EICR must be supplied to a Tenant before they move into the property and a new one be supplied to them at the expiry of the previous one.
4. Right to Rent Checks:
Under the Immigration Act 2014, landlords in the UK have a responsibility to conduct Right to Rent checks on prospective tenants to verify their immigration status. This involves verifying the identity and immigration documents of all adult occupants. It's important to follow the Home Office guidelines and retain copies of the documents for future reference.
5. Maintenance Responsibilities:
As a landlord, you are responsible for maintaining the property and ensuring that it remains in a good state of repair. This includes repairing and maintaining the structure, heating systems, plumbing, and electrical installations. Regular inspections can help identify any maintenance issues early on, allowing you to address them promptly.
6. Deposit Registration:
When you collect a deposit from your tenants, you must protect it using a government-approved tenancy deposit protection scheme. This protects the deposit and ensures that it can be returned to the tenant at the end of the tenancy, provided there are no outstanding rent arrears or damages beyond normal wear and tear. The tenancy deposit must be registered within 30 days of receiving it and a copy of the prescribed information and certificate given to the tenants. If any third party pays a deposit on behalf of tenants, they too must be stated on the prescribed information and certificate.
7. Tenant Quiet Enjoyment:
Tenants have the right to enjoy the property without unnecessary disturbance from the landlord. This means you should respect their privacy, provide reasonable notice before entering the property for inspections or repairs, and handle any necessary repairs or maintenance promptly to avoid inconvenience.
